N.M. 396, 405, 489 P.2d 253, 261 (1971) (finding that a defectively labeled container is a defect that renders the goods "unfit for ordinary purposes"); Myer v. J.P. Hamman Co., 76 N.M. 461, 465, 416 P.2d 858, 861 (1966) (holding that defective condition of a lumber company's sales slips rendered the lumber company's order "defective"); Smith v. L.J. Brillson Co., 50 N.M. 328, 333, 175 P.2d 924, 928 (1946) (rejecting "the novel concept that the slightest negligence is a defect within the meaning of a statute providing for the revocation of an unconditional and unqualified sale on the ground of a defect in the merchandise or the container in which it was shipped").
[¶16] Based upon the plain language of § 41-01-46, we hold that a lack of a reflective strip on the reflector of a stop lamp is a material defect that renders the stop lamp defective and renders the vehicle it is attached to, defective. For these reasons, the district court correctly applied N.M. Stat. Ann. § 66-1-4, and we affirm the court's entry of summary judgment in favor of State Farm.
